Welcome to Imgr ("we," "us," or "our"). By accessing or using our website and services, including the Imgr image optimization proxy and dashboard (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Imgr provides an automated image optimization service. We act as a proxy between your users and your origin server (or DigitalOcean Space), optimizing images on-the-fly to improve performance. Our service includes image compression, resizing, and format conversion (e.g., to AVIF or WebP).
To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Your use of the Service is subject to the usage limits defined in your subscribed plan (e.g., monthly request counts, bandwidth, or number of projects). Exceeding these limits may result in service degradation or additional fees as specified in our pricing tiers. We reserve the right to modify pricing or plan features with reasonable notice.
Imgr does not claim ownership of the images you process through our Service. However, by using the Service, you grant us a limited, worldwide, non-exclusive license to process, optimize, and cache your images solely for the purpose of providing the Service to you and your users.
The Service itself, including its software, designs, and trademarks, is the property of Imgr or its licensors and is protected by intellectual property laws.
You are solely responsible for the images and content you process, optimize, or serve through the Service. This includes ensuring you have the necessary licenses, rights, or permissions to use, distribute, and serve such images. Imgr acts as a technical intermediary (proxy) and does not pre-screen content. If you use the Service to serve images from external URLs or third-party sources, you represent and warrant that you have the legal right to do so. In the event of unauthorized usage of images, the legal responsibility and liability remains entirely with the user who initiated the request to our servers.
Imgr respects the intellectual property rights of others. If you believe that any image served by our CDN or through our Service infringes upon your copyright, please contact us immediately through our Contact Page or by emailing legal@imgr.ch.
Upon receipt of a valid notice of infringement, we will act promptly to remove or disable access to the allegedly infringing material. We reserve the right to terminate the accounts of users who are found to be repeat infringers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users of the Service, us, or third parties, or for any other reason.
These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
We may modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this site. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
